| 摘 要： | 电子商务的蓬勃发展需要对电子数据能否用以证明案件事实这个基本问题作出回答.作者认为电子数据可以作为证据采纳,电子数据应被看作原始证据、直接证据、书证;对电子数据可以采取多种证据保全措施;在根据电子数据证据定案时,应结合电子数据的具体特点审查其真实性、相关性和合法性.

| Abstract: | Vigorous development of E commerce calls for solutions to the basic problem of whether electronic data can be applied to prove case validity.The writer holds that electronic data can be adopted as evidence because electronic data are regarded as original evidence,direct evidence and written evidence.The protective measures should be taken to electronic data.When the verdict is passed upon electronic data,the reality,relativity and validity should be checked on the basis of the specific characteristics of electronic data. |
