| 摘 要： | 合同履行中的附随义务,是债法中的传统问题,在理论界偶有论述。目前,随着司法实践中这一类型案件的大量出现,它开始受到理论界和实务工作者的极大重视。笔者认为,对合同履行过程中的附随义务的概念,发生根据、特征、内容、责任承担方式进行梳理,对于理论研究和司法实践都具有重要意义。

| Abstract: | The incidental obligation in executing contracts, which is occasionally dealt with in the theory circle, is a traditional issue in the law of debt. Nowadays much more importance has been attached to it as a large number of cases of such kind are arising in judicial practice, The analysis of its notion, bases, characteristics, content, ways of undertaking responsibilities is vitally significant to the theoretical study and the judicial practice. |
