| 摘 要： | 精神损害赔偿的适用范围是整个精神损害赔偿制度的关键,是权利主体据以索赔的请求权基础问题。目前,我国的精神损害赔偿的范围仅限于民事侵权的情况,对于刑事附带民事诉讼的被害人、国家赔偿案件中的受害人、合同违约纠纷中的权利人等的精神损害赔偿权却不予保护。本文拟就精神损害赔偿适用范围的相关问题进行探讨,并提出自己的观点和看法。

| Abstract: | The application of mental injury compasation is the key to the whole compasation system, which is the basic problem to the subject who has right to claim. At present, it is limitted in the case of civil wrong, with the exception of victims in cidental civil action, national compasation and the disputes for breaking of contracts and so on. The problem concerning the appl icable limits are discussed and the views are given in this paper. |
