| 摘 要： | 正当防卫是我国刑法的一项重要制度,是法律赋予公民同违法犯罪行为作斗争的一种权利和手段,但因实践情况复杂,防卫性质在判定时往往难以做出明确的界定,所以准确把握正当防卫的构成要件,分析防卫行为的目的、时限、对象和限度,对于正确地对防卫行为定性,辨析罪与非罪的界线,正确适用法律意义重大.

| Abstract: | Justified defence, which is an important system in our criminal law, is the right and means , entrusted to us by laws, to struggle with criminals. But it is hard to define the quality of defence for the situlation is complex in practice. So to master the conditions to consist of Justified defence, to analyse the aim,time limits, object and limits of defence is meaningful for us to define Justified defence correctly,to analyse criminal or norcriminal. |
