票据权利取得之比较法探析

票据流转过程中的诸多因素致使票据的持有人所应有的票据权利的完整性受到妨碍。票据行为独立原则、人的抗辩限制及善意取得等制度，对于保护善意持票人的票据权利之外，尚须力求当事人的公平与合理。参照国际票据法以及英美法国家的票据立法修正我国相关票据权利条款之缺陷以完善票据权利制度理应成为将来票据立法之首选。
