| 摘 要： | 服刑人员的结婚权是我国法律的空白点.有学者以保障人权和"法律没有禁止就是允许"为据主张给服刑人员的结婚权.但从我国刑罚的本质及目的是报应与特殊预防的统一,在偏重特殊预防的基础上兼顾报应和罪犯权利的不完整性、依附性来考虑,一般情况下,服刑人员不应该享有结婚权. |

| Abstract: | At present,the marriage right of the persons serving sentences is still non-existent in our country's law.Some scholars hold that it is necessary to grant the persons serving sentences the right to marry.But,in consideration of the essence and purpose of criminal punishment in our country,and the incompleteness and dependency of criminals' right,the persons serving sentences should not enjoy the right of marriage under common circumstances. |
