宗教对法律的启示

法律和宗教一样,是一种意识形态,一种社会规范。宗教对法律的启示表现为三个方面:一是宗教既有现实的一面,又有虚拟的一面,正因为宗教有虚拟的成份,才构成了信仰的基础;法律也应该包含虚拟的成份,不能只停留在现实层面的说教上。二是宗教非常强调程序形式和程序活动,正因为宗教对程序的推崇,才树立了宗教的权威;法律也应该强调程序形式和程序活动,通过强调法律程序来建立法律权威。三是宗教强调一种精神,正因为宗教对精神的景仰,才使得宗教拥有广泛的社会基础;法律也应该倡导一种精神,唯其如此,共同的法律价值观才能建立,法治才会拥有广泛的民众基础。

Religion's Enlightenment on Law

Same as law, religion is a social standard and ideology. There are at least three aspects regarding religion's enlightenment on law. Firstly, religion is both real and fictitious. It is the fictitious elements that constitute the basis of belief. The law should also have fictitious elements which should not remain a sermon at the reality level; Secondly, religion much stresses the forms and activities. It is because of the stress on procedures that the religious authority is established. The law should also stress the forms and activities. The authority of the law can only be achieved by stressing the legal procedures; Lastly, religion stresses a spirit. It is because religion has a belief in spirit that religion boasts a broad social basis. Law should also advocate a spirit. Only in this way can the legal value be established and legislation have a broad public basis.
