| 摘 要： | 调解人中立不是任由当事人自由角力的消极中立,调解人干预也不是剥夺当事人自治的积极干预.调解人恰切的行为模式应当处于消极中立与积极干预之间.一方面,调解人的价值观可以适当渗透于调解过程,帮助当事人达成互利共赢的和解方案;另一方面,调解人的力量可以适度介入调解过程,平衡当事人间的力量关系.但不论是价值观渗透还是力量介入,都会将调解人置于偏离中立的伦理困境,而缓解这一困境的策略则要在实践知识中探寻.
