论法治视野中犯罪研究的方法论立场

在刑事犯罪领域中通过构建科学的法治理论，贯彻法治精神、推进法治实践是当代犯罪学和刑法学研究者责无旁贷的使命。而对于犯罪研究及其方法论而言，法治立场的建构却面临着许多任务。为此，必须以社会物质生活条件作为犯罪研究方法论的逻辑起点、以对犯罪现象的实证分析作为刑事立法科学化的客观基础、以对犯罪研究的规范分析作为刑事司法客观化的技术支持，从而进一步推动我国犯罪研究的发展，以期实现我国刑事犯罪领域内的法治化。
