| 摘 要： | 本文运用政治学的视角,从宏观与微观两个层面分别对大法官任命过程中的政党因素进行了静态与动态的分析,并进一步从美国三权分立、互相制衡的政府体制、两党政制、联邦最高法院的权力与职能、联邦最高法院的精英设置等方面,考察了导致大法官任命过程中强烈的政党因素的具体成因。
