| 摘 要： | 片面组织犯是指在实行犯并不知情的情况下,暗中组织、指挥、策划其犯罪行为的组织犯。组织犯的不同存在范围,制约着片面组织犯的存在与否。组织犯只能存在于犯罪集团中。如果行为人用暗示的方法组织的犯罪集团因意志以外的原因而未能实施预谋的犯罪,则该行为人成为预谋犯罪预备犯的片面组织犯。

| Abstract: | A one-sided organizing criminal refers to the organizing criminal who organizes,commands and plans the crime that is committed by the perpetrator who has ignorant of the crime before.The existence of one-sided organizing criminal depends on the different fields where he is present.An organizing criminal can only be in a criminal group.If the criminal group organized by the actor has not committed the premeditated crime for non-purpose reasons,the actor becomes the one-sided organizing criminal of the preparatory crime. |
