WTO与宪法制度安排

入世将使中国市场化提升到一个新的水平 ,政府对市场的干预应当大幅度减少 ,防止和解决政府失灵的问题 ,以体现社会正义。政府失灵的根源是宪法约束失灵 ,改变宪法约束失灵和限制这种超过公众需要的政府扩张的根本途径是宪法改革 ,WTO通过对其成员国的宪法制度安排施加影响来实现对政府行为的约束。

WTO and Arrangement of Constitutional Systems

China' entry into WTO will raise its market to a new level.The government should lessen its interference with the market to a large extent,prevent and solve the issue of government failure to embody social justice.The source of government failure lies in the failure of constitution restriction.To change it and restrict the expansion of government beyond the needs of the masses,the only way is to conduct constitution reform.WTO exercises its control over government behavior by influencing the arrangement of constitutional system of the member countries.
