探析我国养老保险法律制度存在的问题及立法建议

养老保险法律制度是社会保障制度的重要组成部分，建立完善的养老保险法律制度，不仅能保障职工老有所养、老有所靠，而且能减轻企业负担，有利于企业公平参与竞争和人才交流，促进经济发展与社会稳定。本文从养老金筹资模式、基本养老金替代率及退休年龄等方面分析我国现行养老保险法律制度存在的问题，同时就上述问题和养老保险法律制度的良性运行提出相应的立法建议。

Current Problems in China's Pension Security System and Suggestions for Legislation

Pension is an important component of social security system. It is important to establish a sound pension security mechanism so that the old can live a happy life and the former employers can have their financial burdens eased. Based on pension financing modes, substitution rate for basic pension and retirement age, this paper discusses the present problems in China and proposes some ways for legislation.
