探究中国农产品国内支持的法律保障

对农产品的国内支持有着深刻的理论渊源。WTO《农产品协议》是规范农产品多边贸易体制的重要规则之一。该协议中的国内支持规则规定了不要求各国作削减承诺的"绿箱"措施和要求各国作削减和约束承诺的"黄箱"措施,还专门规定了对发展中国家农业国内支持的特殊差别待遇。比较发达国家和发展中国家农产品国内支持制度,对于完善我国农产品的国内支持是有启示和借鉴意义的。针对我国长期以来农业支持力度严重不够、结构不合理的现状,探究WTO《农产品协议》框架下中国农产品国内支持的法律保障是非常重要的。

Research on Legal Guarantee for National Support of Agricultural Products

There are profound theories on national support of agriculture. The rules of national support of agriculture in WTO Agriculture Agreement contain the Green Box measures which do not require the members to make reducing promise and the Yellow Box measures which ask them to make reducing and banding promise, also including special treatment on national support of agriculture in developing countries. The comparison of the national support system between developed and developing countries will have influence on improving the national support of agriculture in China. Facing the situations, China has not given enough support to the development of agriculture.To meet the requirement of WTO Agriculture Agreement,it is important to study the legal guarantee for national support of agriculture in China.
