| 摘 要： | 词汇空缺现象是跨文化交流中常见的问题，它给跨文化交流带来障碍，给翻译造成麻烦。本文从法律文化角度分析了英语法律术语汉译过程中词汇空缺现象产生的四个主要原因：法律传统，现实生活，社会制度和民族心理，并就英语法律术语的翻译提出具体原则与策略：尊重惯译、直译、直译加解释和解释翻译法。最后，作者还就法律术语翻译的规范和统一问题提出建议。

| Abstract: | The phenomenon of lexical gap is a common problem in cross-cultural communication, which causes trouble to cross-cultural communication, particularly to inter-translation. This paper analyzes the four main causes leading to the occurrence of lexical gap in translation of English legal terms: legal tradition, real life, social system and a people's psychology within a legal culture, and puts forward specific principles and strategies to the translation of English legal terms. At the end of this paper, the author makes some suggestions on the regulation and unity of translation of legal terms. |
