我国死刑政策落实现状分析

由于我国当前尚不具备废除死刑的社会物质条件和文化、法制观念等条件 ,所以我国一贯实行严格限制死刑适用的刑事政策。但是这一刑事政策在落实过程中 ,由于封建重刑主义思想、传统价值观以及我国现阶段经济和治安状况的影响 ,在实体控制和程序保障方面都出现了种种问题 ,除了在死刑适用对象限制方面值得肯定外 ,不论是死刑适用条件、死刑实际执行制度 ,还是死刑程序保障方面都没有充分体现严格限制死刑的政策 ,使得我国的死刑政策没有得到充分贯彻 ,甚至还与死刑政策发生了某种背离。

Analysis on the Implementation of Policy on Death Penalty

As the conditions for abolishing the death penalty in China are not sufficient in material, culture and legal concept in society, China has been carrying out the criminal policy of death penalty that is strictly limited. But as a result of the thoughts of feudal severe punishment doctrine and orthodox values as well as the economic actuality and public order situation of our country, in the implementation process of this policy, there are lots of problems in the aspects of substantive control and safeguarding procedural. Except for the object restraint of the death penalty application, the application condition and execution system of the death penalty do not embody the death penalty policy so that this policy could not be fully implemented, and the implementation deviates from the death penalty policy in some extent.
