证券化视角的地票交易制度创新及立法路径

地票交易制度的价值在于通过证券化形式创新土地交易的方式，发挥了其统筹配置城乡建设用地资源的作用，创造性地运用了证券化的融资功能、资源优化配置功能、财富收入分配功能以及公共政策促进功能，为农村集体建设用地资本化．以及建设城乡统一建设用地使用权市场化探索了新途径。应当在现有经验的基础上，按照证券化的基本思路，探索提升地票交易的法制化、市场化、权利化的途径，科学界定政府在地票交易中的角色，有效保障土地权利人在地票交易中的主体地位，从制度上更好地发挥市场机制的基础性作用。

Research on Legislation Issues of Land Exchange in the View of Securitization

The core of securitized land exchange regulation innovation lies in reforming the land exchange method by securitization,taking the advantage of its function in deploys urban and rural construction land resources,creatively using all kinds of function of securitization such as financing,resource optimization capabilities,income distribution and promotion of public policies,which explored a new way for capitalizing rural collective construction land and establishing a unified urban and rural construction land market.At present,some difficulties in regulation of securitized land exchange exist,On the basis of existing experience,we should follow the way of securitization,focusing on exploring legalized,market-oriented,rights-based approach,defining the government’s role in the securitized land exchange correctly,ensures land right owners’ dominant status in land exchange market,allowing marketing mechanism plays the basic role in it.
