我国法治政府建设的检视与路径展望——以行政行为的全面规范化为视角

改革开放30年，我国的行政法制建设取得了巨大的成就。政府的行政作为得到了很大程度的规范。但长期以来，行政不作为严重影响了政府的公信力，与依法治国、执法为民的社会主义法治理念相悖。随着社会的发展，行政不作为呈现出多种新的表现形态。文章从行政权本位、政府机构职能交叉、部门利益驱动、权利救济机制不健全等方面全面检视我国行政不作为的生成机制，并进一步展望了法治政府建设过程中规制行政不作为的法律路径。

The Inspection and Prospect of Legal Government Construction in China: in View of the Comprehensive Standardization of Administrative Actions

Within the 30 years development of Reform and Open Policy, the administrative legalization has had great achievement in China and the administrative actions have mostly been standardized. But for a long time, the administrative nonfeasance has seriously influenced the public confidence in government, which contradicts the socialist legality idea of managing state affairs according to law and enforcing law for people. With the social progress, the administrative nonfeasance has embodies many kinds of new forms. The paper inspects the forming mechanism of the administrative nonfeasance from the executive power standard, government apparatus function overlapping, department benefit actuation, imperfect mechanism for right relief, etc. Furthermore, it forecasts the legal way to regulate the administrative nonfeasance in the process of constructing a legal government.
