| 摘 要： | "中道"是中国传统文化的"道统",也是古老中华法系的"法统","和"是道之用,也是法之用。"和实生物"包含"和实生法"。从"中和"之道可以看到"中和"之法的三个特征:"中和"、"中正"、"时中"。从贵"和"之礼可以展现贵"和"之法的七个层面:道德与法律之"和"、法的天人之"和"、法统之"和"、实在法之"和"、综合为治之"和"、定罪量刑之"和"、法律生活之"和"。

| Abstract: | ＂The middle way＂ is Confucian orthodoxy of Chinese traditional culture,and also the legal constituted authority of ancient Chinese legal system.＂He＂（harmony） can be used in both the Confucian orthodoxy and legal constituted authority.We can find the characters of legal constituted authority from Confucian orthodoxy,and the rite of valuing harmony from the legal connotation. |
