劳动教养制度的犯罪学思考

随着犯罪学在我国的兴起和发展,犯罪学研究成果颇丰,各种犯罪学论著为我国犯罪学学科建设和防止、减少犯罪奠定了基础。但是在劳动教养制度的存废之争面前,犯罪学关于劳动教养的研究却沉寂已久。劳动教养制度在性质、范围、对象、执行各方面和犯罪学在理论和实践层面上的研究息息相关,犯罪学研究应该关注社会现实中的犯罪倾向和治理,应该在劳动教养制度存废以及改革发展方面作出应有的贡献,以完成时代所赋予的犯罪学研究的历史使命。

The Criminological Reflection for the System of Reeducation through Labor

With the development of criminology,the achievements of criminological research help the establishment of the subject of criminology in China and lay a foundation for preventing and reducing crime.Criminological research and the system of reeducation through labor is closely related with each other in such aspects as in theory and practice,in nature,range,target and execution.However,in terms of establishing and abolishing the system of reeducation through labor,the criminological research on the reeducation through labor has kept silence for a long time.The criminological study should make its contribution to the existence and reform of the system of reeducation through labor in order to complete the historical mission of contemporary criminology.
