| 摘 要： | 《刑法修正案(八)》新增第133条之一,最高人民法院将本条罪名抽象为危险驾驶罪,"醉驾"、"飙车"这两种违反交通安全管理法规的行为确立为犯罪,使之从行政处罚领域进入到刑法控制领域。从刑事立法学上讲,危险驾驶罪构成要件的设立,是中国刑法上的一个重大突破,对于日后刑法立法乃至司法均将产生重大影响。对此,首先需要从规范层面上认真思考,同时需要从刑事政策层面上进行思考。"醉驾"型和"飙车"型两种不法行为在构成要件上具有明显差异,其真正的共同点是,在各自的罪状当中都没有出现的"不能安全驾驶"这一构成要件。也就是说,危险驾驶罪包含着"不能安全驾驶"的构成要件,而这也就是"醉驾"型危险驾驶罪和"飙车"型危险驾驶罪本质性的共同构成要件。

| Abstract: | According to the newly added Article 133 of Amendment(VIII) to Criminal Law of the People’s Republic of China,the Supreme People’s Court stipulates that"drunk driving"and"whirlwind driving"belong to the criminal acts,which is a great breakthrough in law-making.First,normative level is taken into account seriously and then so are the criminal policies,for"drunk driving"and "whirlwind driving"are different,but their common ground is driving without safety,namely,dangerous driving,which is rightly the making-up of dangerous driving. |
