| 摘 要： | 国际刑法的本质属性、机能、功能与作用是国际刑法学的四大基本范畴。迄今为止,学界尚未全面、深入地探讨它们的本质、内涵、它们之间的逻辑关系以及研究它们的理论与实践意义。笔者从本质属性、机能、功能与作用的基本含义出发,结合国际刑法的发展历史和国际刑法学的学科特点,尝试性地论述了以上问题。

| Abstract: | The essential property,mechanism,function and effect constitute the four major categories of the science of international criminal law.Unfortunately,the jurisprudential circle has failed to make any comprehensive and deep-going study of their innate character,connotation,logical relationship and theoretical and practical significance.Therefore,the author of this paper attempts to expound these points. |
