闭海或半闭海制度下海洋环境保护合作的立法模式探析与启示

闭海或半闭海特殊的地理特征决定了人类应该更加重视在该区域的环境保护。近年来,全球合作、双边合作保护闭海或半闭海区域海洋环境的弊端日益凸显,闭海或半闭海制度为创新此区域的海洋环境保护合作提供了理论来源与实践路径。世界各国在闭海或半闭海区域的海洋环境保护合作中主要采取了三种不同的立法模式,这三种立法模式为推动南海区域海洋环境保护合作的发展、促进培育成熟的南海海洋环境科学认知共同体、选择符合南海海洋环境保护合作的立法模式以及我国在南海地区发挥区域大国的主导作用等方面提供了重要启示。

Analysis and Inspiration of Legislature Modes of Marine Environment Protection under the System of Enclosed or Semi-enclosed Seas

The geographic characteristics of enclosed or semi-enclosed seas require human beings to attach more importance to the environmental protection of this area.Recently,the protection of enclosed or semi-enclosed marine environment through global and bilateral cooperation is displaying increasingly prominent disadvantages,and the system of enclosed or semi-enclosed seas provides theoretic sources and practical approaches for the innovation of marine environment protection.In the cooperation of the marine environment protection of enclosed and semi-enclosed seas,all countries in the world have adopted three different legislature modes,which offer important inspiration in the following aspects:promoting the cooperation development of marine environment protection of the South China Sea,enhancing the nurturing of matured community of scientific recognition concerning the marine environment of the South China Sea,the future choice of the legislature mode suitable for the cooperation of marine environment protection of the South China Sea,and China’s leading role as a regional major country in the South China Sea.
