| 摘 要： | 现阶段职务犯罪研究上的分歧 ,及我国行政改革的实践使公务员犯罪的概念的引入势在必行。公务员犯罪具有概念上的确定性 ,主体范围的明确性 ,典型性和代表性 ,有助于权力职能的明确等优点。在公务员犯罪认定上应实行主体限定性原则 ,行为相关性原则 ,行为违法性原则。在公务员犯罪的防控上 ,应实行多层面的措施。
