| 摘 要： | 价值判断方法引导了民法基本价值从近代民法＂安定性＂向现代民法的＂妥当性＂转变。价值判断方法以两种方式发挥引导作用：其一是作为法学通用方法引导立法的价值取向;其二是作为独立的民法解释方法在法的适用领域发挥价值再判断和价值修正的作用。两种方式上的价值判断方法合力推动民法现代化进程中的价值取向改变,实现了近代民法向现代民法的转变。

| Abstract: | The methodology of valuation guided the translation of valuation from the invariability in the modem civil law to the suitability in the contemporary civil law. The valuation works in the following two ways： one as the general legal methodology to direct the legislation; the other functioning as the separated civil interpreting methodology to revalue and value revision in legal applicability. These two ways combine to promote the modernization of the civil value orientation, and then achieve the transition from the modem to contemporary civil law. |
