完善我国劳动争议仲裁制度的探讨

摘    要:
尽管我国的劳动争议仲裁制度从发展至今已有几十年历史 ,并且发挥了社会稳定器的作用 ,保障了我国经济的稳步发展 ,但由于其行政色彩过浓 ,加上强制管辖和一裁两审制的实行 ,限制了其作用的发挥 ,且造成了人力、物力、财力的巨大浪费 ,故应分步骤进行改革和完善 ,首先应加强其独立性 ,其次是改变仲裁和仲裁机构的性质 ,最终实行向统一仲裁的回归。

Abstract:
Though the arbitration system of labour dispute ha s been for decades in China so far and plays a very important role for insuring th e stable development of China's economy, the system of one arbitration with 2 tr ials governance is implemented compulsorily, it limits the arbitration functions and wastes too much resources, manpower and finance. Therefor it shall be refor med and perfected step by step. First the independence of the system shall be st rengthened, secondly, the characters of arbitration and arbitrate organization s hall be changed, finally, unified arbitration shall be performed.
