| 摘 要： | 由于我国本土法律资源与移植法律的冲突、检察权各项权力内容间的冲突与制约、检察权在刑事诉讼活动中与其它国家机关权力的冲突以及检察权的运行冲突导致了检察权的定位矛盾。解决检察权定位问题应突出检察权的司法权性质,并要在加强检察机关和检察官的司法独立性、改变检察机关法律监督权的行使方式、进一步完善公诉权、理顺检警关系、改变检察机关内部制约机制等几方面进行制度完善。
