| 摘 要： | 非法人团体广泛参与着民事活动,它有着不同于自然人和法人的特征,而且它的法律特征和现状完全符合确立民事主体的相关要件和标准,我国民法应该打破传统的民事主体二元结构,赋予其民事权利能力,使其成为我国第三类民事主体。

| Abstract: | The unincorporated body takes part in civil activity enormously, but it has its own features different from natural person and corporation. Furthermore, its characteristics of law and status quo completely match with the term and standard to definite civil subject. Therefore, Chinese civil law should break civil subject's conventional two-dimensioned structure and endow unincorporated body with legal capacity for civil rights to make it become our country's the third civil subject. |
