金融调控权的约束机制与责任分担

金融调控是国家宏观调控的重要组成部分，各国法律一般赋予中央银行金融调控的权力，《中国人民银行法》也明确规定了中国人民银行在国务院领导下行使金融调控权。鉴于这项权力的重要性和复杂性，选取金融调控权的主体、内容、特性以及金融调控权的约束机制和不当行使金融调控权的责任承担问题进行分析，提出从程序规范的角度制约金融调控权，并强调责任与权力必须同时规定于法律之中。

Financial control,which is generally executed by central bank of an economic entity, is an important part of national macro-control. Law of the People＇s Republic of China on the People＇s Bank of China authorizes the People＇s Bank of China exercises the power of financial control under the leadership of the State Council. In view of the inoportance and complexity of this power, this article only selectS Several issues,that is,the owner, Classification, Characteristics, regulating mechanism and accountability of the power of financial control.At last, the article suggests that procedures be established to regulating the power of financial control and accountability and power must be regulated in the law.
