Analysis on Constitutionalism from the Perspective of Legal Philosophy

Constitutionalism is the fruit that human intelligence bears, and the crystallization of political and rule-of-law civilization. In retrospect of historic development of constitutionalism, its origin lies in liberalism and republicanism; the system of constitutionalism entails theories and practices in terms of democracy, rule-of-law and human rights; at the same time, development of market economy as well as the dualism of the state and civil society provides the foundation for the formation and development of constitutionalist system. From the perspective of legal philosophy, these issues constitute the theoretical, political, economic and social bases for the development of constitutionalism. Rational reflections and analysis on these matters, especially from the perspective of legal philosophy, would furnish the studies of constitutionalism with scientific theoretical basis.
