| 摘 要： | 目的探讨我国病人的知情同意权立法状况.方法分析了病人知情同意权的内涵、性质、行使形式.结果我国病人的知情同意权尚未得到有效的法律保护.结论建议修订<执业医师法>,加快制定包括知情同意权在内的病人权利法,以最大限度地保障病人的权利.

| Abstract: | Object The paper attempts to reveal t he defects existing in the legislati on of patients' informed consent rig ht in Chi-na.Method It is important to find the way to realize the right after the ess ential analysis of its conceptions a nd nature.Result In China laws haven't been applied prop erly to protect the patients' right s ufficiently.Conclusion The law of p atients' rights sustaining informed consent right should be perfected,so those patients can derive benefits from it as much as possible. |
