| 摘 要： | 国家的法治建设离不开传统文化的归因,过多地注重西方法治理念与制度的学习与移植不利于推进中国的法治现代化。建构中国的法治社会需要吸纳现代法治观念和先进的法律文化,同时也必须植根于传统文化的基础,承继传统文化中的合理内核,以建构符合中国传统文化、切合中国人习惯特点、具有现代法治精神的新的中国现代法律体系。

| Abstract: | A national rule of law culture is closely related to its traditional culture.The modern rule of law more emphasizes on transplantation advanced legal system and ideas of Western.The construction of Chinese society ruled by law needs to absorb modern legal concepts and advanced legal culture,and also must be rooted in foundation of traditional culture,inherit the reasonable core of traditional culture,to construct a modern legal system in China in line with China’s traditional culture,and to meet the characteristics of Chinese customs and the spirit of modern rule of law. |
