| 摘 要： | 建筑物区分所有权是现代民法一项重要的不动产所有权形式。首先以建筑物区分所有权的传统“三元论”理论为基础,对建筑物区分所有权的管理权与成员权的概念以比较分析的方法进行分析,论证了新“三元论”修正的必要性和管理权概念较成员权概念的优越性。

| Abstract: | The "building distinction ownership" is an important form of real estate property rights in modern civil law.On the basis of traditional triarchic theory of building distinction ownership,this paper makes a distinction between the concepts of exclusive right and member's right,discusses the necessity of revising the new triarchic theory,and advocates the superiority of exclusive right over member's right. |
