| 摘 要： | 宋代的担保行业是其商品经济高度发展的产物,担保行业适合了其商品经济高度发展的需要,并贯彻到了商品交易的各个方面,发挥着重要作用.尤其在预买和赊买卖中,担保的作用更为凸现.宋朝法律赋予保人以特殊的经济地位和权利,是宋代担保制度发达的重要原因.从整体来看,宋代担保行业与其商品经济高度发展之间既有相适合的一面外,也有不相适合的一面,而且不相适合的一面又严重阻碍了宋代商品经济的发展.
