法治国家:中国特色社会主义的政治目标

以法治国家为目标 ,是社会主义民主政治建设的重大突破 ,也为中国特色的社会主义政治建设明确了方向。法治区别于法制 ,在其内容、功能、实现条件等方面较法制有着更深刻的内涵。法治国家的建设是适应一国国情的民主政治建设。我国法治国家的目标在其形成和实现过程中有着自身的特色。确立法治国家目标 ,是适应社会主义市场经济 ,在社会主义法制建设基础上 ,为根本解决社会转轨过程中所出现的问题而进行的制度创新。在实现法治国家的目标过程中 ,从人治走向法治 ,是我国法治建设的基本内容 ,要发掘和利用人治传统中的积极因素 ,实现从人治向法治的过渡。法治建设是一个渐进的过程 ,始终必须处理好推进法治和经济发展、社会稳定的关系。法治建设也是一个改革和开放的过程 ,要处理好法制的统一性和法律实施多样性的关系 ,处理好学习、借鉴外国法治经验和坚持我国特色法治道路的关系。

Legal State: Political Goal of Socialism with Chinese Characteristics

To build a law ruled state, as a constitutional goal, makes an important breakthrough in building socialist democratic politics. To rule in accordance with law is different from merely setting up a legal system in that they possess different content, function and conditions for realization. The formation of a legal state in our country has its own characteristics. It makes an institutional creation based on building a socialist legal system to meet socialist market economy and solve those problems which emerge during social change process. The process to realize the goal of building a legal state is a transition from ruling by elite to ruling by law. We should find and utilize active elements in the tradition of the ruling by elite. The building of a legal state is an evolutionary process, in which we must tactfully keep balance between the promotion of the building of a legal state, economic development and social stability. It is a reform and open process, in which we must handle carefully the relation between the unity of a legal system and the various ways of law enforcement and the relation between drawing on experience from other countries and keeping our own characteristics.
