| 摘 要： | 保安处分是刑事古典学派的报应刑论向刑事社会学派的教育刑论转型的结果,以社会防卫论的"人身危险性"为理论基础,崇尚刑罚个别化,注重对危险人的预防与教育,目的是预防犯罪、防卫社会安全.从政治学角度讲,保安处分是国家权力运行的体现,是国家的一种政治实践.从社会学视角观察,保安处分是维持社会整合的强有力的社会控制手段.从伦理学角度而言,保安处分是对伦理道德规范违反者的惩治.总之,保安处分顺应了世界刑法发展的潮流,是法治国向文化国进化的标志,是报应刑向教育刑转型的结晶,能更好地达到防卫社会之效果.
