《合同法》的代理规定与外贸代理制的完善

在《合同法》颁布之前 ,外贸代理制实行了十余年 ,因其缺陷过多推而不广。《合同法》对代理制度的补充和修正 ,使外贸代理制的法律依据更全面、更明确、更完善。随着《合同法》的有关规定适用于外贸代理及外贸经营权的放开 ,外贸代理制的发展会越来越快 ,作用会越来越大。

Contract Law--An Improvement of Agency Regulations and Foreign TradeAgency System

Before the promulgation of the Contract Law the foreign tradeagency system had been taken for over ten years but it was not widelyfollowed due to its shortcomings. The Contract Law, as a supplement andamendment to the agency system, provides a more thorough, clearer andsounder legal basis for the foreign trade agency system. With theapplication of relevant regulations of The Contract Law to the foreign tradeagency system and full authority over foreign trade management the system isexpected to develop rapidly and produce greater effect.
