| 摘 要： | 基于政治民主、权利本位的本质要求,涉及舆论监督性质的网络言论表达面对公权机构或权力行使者刑事指控时,从适度倾斜保护公民表达权考虑,应严格刑事侵犯行为所致后果的认证与证明程序,强化相对人举证指控内容的法定责任,完善刑事诉讼程序,优化刑事制裁体系,明细刑事实体法条款,多途径遏制公权机构滥用刑事处罚,最大限度收缩刑事制裁范围,力戒权力造罪。 |
