政府责任视角下失独家庭扶助制度研究

独生子女父母作为国家计划生育政策的积极响应者,为我国的经济和社会发展做出了牺牲和贡献。独生子女家庭本质上是风险家庭,在一个高风险的现代社会,失独家庭的产生不可避免。随着第一批独生子女的父母逐渐步入老年,失独家庭的养老问题愈发凸显。本文从政府责任的视角,分析在失独家庭养老问题中政府责任的法律基础以及目前我国失独家庭扶助法律法规存在的问题,进而提出政府在失独家庭扶助中应该承担的责任。

On the Aid System for the Families with Only Child Lost from the Perspective of Government Responsibility

As positive responders to the national one-child policy, the one-child parents have made great sacrifices and contributions to China＇s economic and social development. The one-child families are essentially risk families, and the appearance of families with the only child lost is inevitable, especially in the high-risk modern society. With the first generation of one-child parents gradually aging, the problem of supporting the parents with only child lost has become more and more serious. From the perspective of government responsibility, this paper attempts to analyze the legal basis of government responsibility in supporting the aged in the family that lost only child and the limitations existing in the laws and regulations concerning aiding the families with only child lost. In addition, this paper also puts forward the responsibility which government should take in aiding and supporting the families with only child lost.
