| 摘 要： | 特保条款是公认的中国加入世界贸易组织所接受的四个不利条款之一。特保条款是对中国过渡(或转型)期 12年有效的特殊保障规则。特保条款是不公平的贸易条款,不具有“真正的法律”品格,特保条款的执行应该让位于法理,受限于WTO法的目的与宗旨。中国在战略上应认清特保条款的性质,主张特保条款应该用得正确妥当,并进行限制性解释,在战术上应重视应对,最大限度地避免特保条款的滥用。

| Abstract: | Product-specific protection clause is recognized as one of the four unfavorable clauses after China entered WTO. It was valid only during the 12 years of transformation period. In fact, the product-specific protection clause is an unfair trade clause and it doesn't possess the legality of law. It is suggested that product-specific clause should give place to laws. Or it has to be interpreted properly and applied without abuse to the largest extent. |
