行政法学界关于"行政”和"行政权”的讨论

"行政”和"行政权”是构建行政法学理论体系的基本范畴,学者们加强对它们的研究,其意义之重大是不言自明的.从实际情况来看,相对于行政法学中的其它范畴而言,"行政”和"行政权”得到的关注更多,这种关注除了行政法学者之外还有行政学学者、政治学学者、社会学学者等.尽管学者们有关"行政”与"行政权”的认识有一定的共同性,但由于立足点、观察角度和方法的不同,这两个范畴在学者们的眼中又有各自独特的具体内容.在综述行政法学者关于"行政”和"行政权”讨论现状的基础上,我们也简要地发表了自己的看法.

Discussion on "administration"and "administration power"in the field of administration law

Administration" and "administration power" are two fundamental concepts in constructing the theoretical system of administration law, so it is important and necessary for scholars to make further studies of them. In practrice,"adminitration" and "adminitration power" are attached much more important than other concepts in administration law by scholars in adminitration, politics, sociology, as well as adminitration law.Although scholar have reached certain common understanding on "adminitration" and "adminitration power", the two concepts have distinctive contents respectively in the eyes of different scholars due to their different standpoints,observation perspectives and methods. Summarizing other scholars' current discussion on "adminitration" and "adminitration power",the writers of this paper have given briefly their own viewpoints.
