论法治研究的方式

国内法治研究成果不断涌现,对这些研究成果的再研究亦非常重要.文章认为,法治研究在当代中国有三种方式,一是扬弃方式,通过重述或比较的方式研究西方法治理论;二是历史方式,研究法治理论在古代中西方世界的发展以及在近代中国的生长历程;三是理论方式,从法治概念、标准、意义、路径、思维、理论体系等方面入手,建构立基于中国的法治理论体系.

On the way to study the rule of law

Domestic studies of the rule of law continue to emerge, and then study of the results of these studies is also very important. The author thinks there are three ways of studying the rule of law in contemporary China: one way is sublation, namely researches the Western theory of the rule of law by way of comparison and restatement; the second is the way of history, that is researching the theory development of the rule of law in the ancient Western world, as well as in the growth of modern China; the third is the theoretical approach, which starts from the terms of the concept of the rule of law, standards, meaning, path, thinking, and theoretical system, and constructs the China-based theories of rule of law.
