| 摘 要： | 夫妻一方在婚前享有所有权的财产与婚姻无关,仍归个人所有,不应因婚姻的成立而发生所有权的变化。但一方的婚前财产在婚姻关系存续期间的主动增值为他方配偶不可弥补的努力所致时,该增值应当属于夫妻共同财产,归夫妻双方共同所有。

| Abstract: | The property owned by wife/husband before marriage has no connection with marriage,so it should belong to wife/husband personally.Property's ownership should not be changed due to the establishment of marriage.But during the marriage existing period,if the active added value of the property owned by wife/husband results from the efforts of the other party of the property owner,and the efforts cannot be compensated,in this case,the added value should be commonly owned by wife and husband. |
