| 摘 要： | 保险代位权是保险法历史上一项古老的制度,近来一些学者对其存在的合理性、必要性提出了质疑,甚至主张废除这一制度,这种观点有悖于保险代位权存在和发展的历史规律,尤其不符合中国现阶段经济社会发展的现实。针对废除保险代位权的理由,从保险代位权存在的理论基础、现实状况、价值功能等方面对其存在的合理性、必要性进行了论证。

| Abstract: | The subrogation right of insurance is an old system in the history of insurance law.In recent years,some scholars question whether the system is reasonable and necessary or not.Some even suggest abolishing it The paper thinks such viewpoint goes against the historical law of the existence and development of insurance subrogation right and is not tally with China's actual situation of economic and social development in the present stage.The paper intends to prove the reasonableness,necessity and value of the system in view of its theoretical basis,actual situation and functions. |
