| 摘 要： | "无讼"在中国古代一直是统治阶级所追求的理想境界,有着深刻的历史渊源,并对社会产生了很大影响.对"无讼"产生根源及发展过程这一问题的探求,有助于我们重新认识本土的传统法律文化,在关于法律本土化和法律移植这个问题上作出适合中国的选择.我们要正确对待本土法律文化资源,以免在构建中国法制体系的过程中多走弯路.

| Abstract: | No dispute had always been an ideal pursued by the ruling class in ancient China. It not only has a long history, but exercises tremendous influence on the society as well. A study on the origin and development of no dispute can help us to re-know China's traditional legal culture, and make a good choice in face of such problems as localization or transplanting. We need to take a good attitude toward the local culture resources so as to avoid the bumps in the construction of the law system. |
