WTO与生物多样性公约的关系及我国的环境法律应对

WTO与生物多样性公约(CBD)两大规则在内容上出现许多交叉、关联现象.CBD有积极追求生物资源经济价值的意愿,而WTO在保证贸易自由的前提下,比其前身GATT给予环境保护更切实的关注,但CBD与WTO之间仍然存在不少分歧和碰撞,两大规范之间仍有许多的空白地带急需协商.对WTO与CBD,我国可采取的法律应对包括:积极参加到贸易与环境的各种论坛中,参与制订、修改和影响规则;充分利用国内的规章制度,保障本国利益;充分运用WTO的争端解决机制为生物多样性保护服务.

The Relation Between WTO and CBD and our County's Countermeasures of Envionment Law

There appear many crosses and linkages in the contents of WTO and CBD.CBD has the intention to actively seek the economic value of ecological resources,while WTO,under the preconditions of protecting free trade,pays more practical attention to environment protiction than its former body GATT did.But there still exist differences and conflicts between CBD and WTO.Meanwhile,there also exists blank space between the two norms of the two organizations urgently wanted to negotiate.For this,the legal measures our county should adopt are:actively participating in various forums concerning trade and environment,participating in drawing up,revising and affecting concerned rules;making full use of our codes and regulations to protect our interest,making full use of the dispute solving mechanism of WTO to serve the protection of biological diversity.
