| 摘 要： | 事实的形成不仅仅是规范意义上的证据推演,其形成的背后有更多被我们忽视的"故事"。媒体和公众彼此利用对方的平台,表达和展示自身的利益,无形之中塑造着事实,并通过民意的形式影响着法官的裁判。然而,通过各种途径展现在法官面前的事实是纷繁复杂的,法官需要按照权威的法律将事实格式化,最终的事实形态只能是那些能被法律所涵摄的事实。从社会学意义上看,事实形成的过程是各种力量博弈的结果。 |

| Abstract: | The formation of facts is not only evidence deduction;behind it there are many hidden stories that are neglected by us.Media and general public make use of mutual platforms to express and display their own interests.Unconsciously they shape facts and affect judges’adjudication through the public opinions.However,the facts presented before judges are complicated and they must format the facts using authoritative laws.The ultimate facts must be those within the range of law.Sociologically,the formation of facts is the result of game between various powers. |
