两大法系国家的侦查指挥构造比较与借鉴

运用比较研究法,对两大法系侦查指挥构造进行解析,其目的是将精华之处"洋为中用"。两大法系侦查程序各有特色,通常英美法系国家采用当事人主义侦查指挥模式,对犯罪嫌疑人和被告人的人权保障更加完备;大陆法系国家采用职权主义侦查指挥模式,对犯罪的控制与打击更具优势。因此,我国的刑事诉讼制度改革更应当兼容人权与秩序的均衡,既要体现打击犯罪的需要,又能充分体现尊重和保障人权的趋势,来构建公正、科学的现代刑事侦查指挥制度。

Comparison and Reference on the Structure of Detection in the Countries With Two Different Legal Systems

This article utilizes the comparison on the analysis to two legal systems in terms of detection direction structure,with a goal of making use of the useful experience in foreign countries.The two different detection procedures are working on their own characteristics.The British-American legal system uses the litigant principle in their detection direction pattern,with more safeguard on human rights to both the accused and the suspicious.The mainland legal system,however,uses the authority principle in their detection direction pattern,with a superiority to control the crime.Therefore,our criminal prosecution system must the compatible between the human rights and the order,to meet the needs be of either control of crime or safeguarding of human rights,so that a fair and scientific detection-direction system can be built.
