| 摘 要： | 计划经济体制时代对法律工具性的认识,形成了公法一元化的法律观,市场经济体制的深化改革,初步奠定了公私法二元化格局。但社会转型仍然带着旧有体制的印记,现阶段我国公私法关系突出表现为活跃的市场因素所引发的私权保护诉求与计划体制下的政府管制思维之间的冲突。为了更好地建立公私法之间的动态平衡关系,文章建议通过确立法的回应型模式,即借助于司法部门的能动主义,来增强刚性的法律规范对社会生活的回应能力。
