| 摘 要： | “条约必须遵守”的国际法义务使得我国面临着国际人权公约的国内转化和国际法与国内法之间协调的问题。该问题的解决,现已形成了四种方案。各方案互有利弊,而综合权衡各方面因素,第四种方案即制定国内人权法来改善国内法对国际人权公约的适应性,显得更为合理妥当,应作为可行之选。

| Abstract: | The rule of the implementation of international treaties means that our country has to coordinate the gap between international covenant on human rights and the national law.There are four schemes on how to solve this problem,which meanwhile have both advantages and disadvantages.The fourth scheme that the sovereign enacts human right law for implementing of international covenant on human rights is more reasonable than others and should be the right choice in the future. |
